6. Liability
The user accepts that any access to or use of the site is at their own risk. HAIRSHOP is not liable for any direct or indirect damages that may be caused by the use of the site, particularly in relation to the interruption, cessation, or malfunction of the site, which may result from, among other things, the shutdown for maintenance or repair of HAIRSHOP's computer system, technical failures or network overload, telephone line failures, errors, negligence or fault of Internet service providers or a third party, as well as viruses from the Internet.
7. Orders
7.1. General
To place a purchase order for products or services offered by HAIRSHOP, the customer must identify themselves and submit their order.
To this end, they must complete a form made available to them online, following the instructions provided, where they will indicate in particular their surname, first name (or company name), as well as their e-mail address, postal address, delivery address if applicable, and their telephone and fax numbers.
Once the customer has chosen the products or services they wish to purchase, they definitively validate their order based on the summary displayed on the screen by clicking on the «Send» icon.
By validating the order, the customer also acknowledges having been informed in advance of the general terms and conditions for the use of the HAIRSHOP website and for the ordering of products and electronic devices, and expressly declares to accept them as an integral part of the contract concluded with HAIRSHOP under the conditions provided for in articles 8.2 et seq. of these general terms and conditions.
Computerised records, kept under secure conditions and in compliance with data protection legislation concerning personal data in IT systems, shall be considered as proof of communications, orders, and payments made between parties.
The basket is comparable to a trolley in a supermarket. As long as the customer has not yet reached the checkout, they can remove or add products or change quantities at any time. Likewise, they can abandon the basket and simply leave the store.
This means that concerning their visit to the HAIRSHOP website, they can fill their basket with items without actually placing an order. At any time, they can open the aforementioned basket to check its contents and, if necessary, remove unwanted items.
7.2. Conclusion of the sale contract
Any order will be considered accepted, and the relevant contract will be considered concluded, from the moment the customer receives electronic confirmation from HAIRSHOP acknowledging receipt of the order.
HAIRSHOP assumes that the email address provided by the customer is correct. Order confirmation is considered to have been received when the customer can access it. Upon conclusion of the contract, HAIRSHOP undertakes to deliver or make the ordered products and/or services available to the customer.
The contract concluded will be archived on a computer medium and will be accessible by the client, who will be able to access it upon receipt of the confirmation serving as an acknowledgement of receipt of the order.
7.3. Prices and payment terms
The prices of products and services available on the website are net prices.
Prices are stated in euros and payable in euros. Any mention of prices in currencies other than the euro is for information purposes only.
Payment by the customer is made:
- Pay online by credit card. HAIRSHOP accepts Visa and Mastercard credit cards.
Collection of ordered products from our address is only possible after payment.
For any overseas delivery, delivery will only be made after payment, with the transaction costs to be borne by the customer.
7.4. Right of withdrawal
Under the provisions of the law of January 2014 relating to electronic commerce, for any contract concluded electronically, the customer has a period of 14 working days from confirmation of the order to withdraw from the contract without giving any reason and without penalty.
Unless otherwise agreed, the customer cannot exercise their right of withdrawal for the following contracts:
- A. Services whose performance has begun, with the client's agreement, before the end of the 14-day withdrawal period; ;
- B. Supplies of beauty products, hair and skincare products, and dietary supplements
- C. Please note that electronic devices ordered have a 2-year warranty, starting from the date of purchase on the invoice, which must be returned with the device..
HAIRSHOP will refund to the customer, as quickly as possible and no later than 30 days, all sums received from the customer in execution of the concluded contract. This period begins from the day HAIRSHOP received notification by registered mail or email of the customer's withdrawal.
The customer shall return any delivery received to HAIRSHOP as soon as possible and no later than 30 days. This period begins on the day the customer sends a registered letter or email confirming their withdrawal, with the postmark or email dispatch date serving as proof.
7.5. Delivery
Delivery of the product or electronic device before the seven-day cooling-off period may only be made with the express prior consent of the customer.
The risk of loss or damage to the products/devices is borne by HAIRSHOP for the entire duration of the transport of the products/devices and until the delivery of the products/devices to the customer.
In case of damage, defects, or shortages, the customer must make a written claim by registered post within 24 hours of delivery at the latest.
HAIRSHOP cannot be held responsible in the event of the recipient's absence at the time of delivery of products/supplies and/or in the event that the customer collects or fails to collect the products/supplies from the carrier after the latter has left a delivery notification for the recipient.
Under these conditions, no claims will be accepted.
If the above procedure has been followed and it is proven that the products/supplies were severely damaged before being received by the customer, HAIRSHOP will arrange for a repeat delivery of similar products/supplies.
Any delivery worth over €49 (after deduction of discounts and promotions) to an address in Luxembourg is free for the Grand Duchy of Luxembourg.
In the event that HAIRSHOP cannot fulfil the contract due to the unavailability of the ordered product or device, the customer will be informed of this unavailability via email and the contract shall be automatically dissolved.
Any sums already paid by the client will be reimbursed as soon as possible and in any case within 30 days.
7.6. Return of Products/Supplies
The direct costs of returning products/supplies will remain the responsibility of the customer, unless the return is due to an error attributable to HAIRSHOP.
Only products returned complete, unused, in new condition and in their original packaging as delivered to the customer will be accepted for return or exchange.
8. Jurisdiction of the courts and applicable law
Luxembourgish courts shall have exclusive jurisdiction over any disputes relating to the use, interpretation, or execution of the information and data found on this website, as well as those concerning the performance of the contract concluded with the client.
Luxembourgish law shall apply between the parties.
